The services of "Hertz 24/7"
Hertz offers a car sharing service called "Hertz 24/7". Your registration with "Hertz 24/7" is a one-time registration that entitles you to use a Hertz 24/7 vehicle by the hour. You don't have to waste time queuing at a rental station or signing forms. All you need to do is make a reservation. We ask each and every user of our service not only to treat the vehicle, its parts and accessories with care, but also to respect these Terms and Conditions, the Hertz Rental Terms and Conditions and other users. This Agreement and the terms and conditions set forth herein are not only for your own benefit, but also for the benefit of the Service and the other customers. These Terms and Conditions govern the relationship between you and us with respect to any reservation and use of a vehicle. Unless otherwise specifically stated in these Terms and Conditions, the Terms and Conditions of Hertz Autovermietung GmbH also apply. Please also familiarise yourself with the contents of the Hertz Rental Terms.

Your membership:
1. requirements
Registration form
a. Please complete the registration form on our website. Make sure that your personal details and billing information are correct.
b. Please be sure to provide a valid email address and mobile phone number so that we can send you confirmations and information about your bookings. If these details change during your membership, please inform us immediately. This is the only way we can always keep you up to date.
c. Both before you join and during your membership, please ensure that you meet our eligibility requirements, particularly with regard to driving licenses. If this changes during your membership, please inform us immediately. This also applies to any change in your contact details (address and telephone number).
d. In order to make a binding reservation for a vehicle, you must first complete the registration form in full and send us a copy of all the necessary documents (identity card, driving license) before the start of the rental period. If you would like to take advantage of any special conditions or rates for certain customer groups, you must also send us a copy of the documents required for this purpose. You can send us your documents by post or email or, if applicable, upload them in the Hertz 24/7 app or via a Hertz 24/7 terminal. If your application is not complete and confirmed by Hertz 24/7 at least 15 minutes before the start of the rental, your booking will be automatically cancelled.
e. New registration: If you wish to use a promotional code, please note that the use of only one promotional code per registration is possible. Termination of membership is permitted at any time. After terminating the membership, it is possible to re-register. However, this is only permitted if no misuse of the benefit programmes can be assumed. A new member is one who has not been a member of Hertz 24/7 for at least 6 months.
f. Multiple registration: If we detect multiple logins (= multiple logins under the same, similar or different names), the user accounts will be combined under one account, and you will be notified. Multiple registrations are permitted if you wish to use several separate Hertz 24/7 services and this is permitted by us. Discount programmes can only be permitted once on a new registration.
Driving license
g. It is a condition of your registration that you have held a valid driving license for at least one year and are at least 19 years old. This is required for the entire duration of your membership. You warrant to us that you are in possession of the valid driving license at the time of registration.
h. You must not have been convicted of driving under the influence of alcohol or drugs.
i. For the further processing of your registration we need a copy of your driving license as well as a copy of your identity card to confirm your address.
j. If you have a foreign driving license, you can still register. For details, please contact our Customer Service Centre.
Invoice details
k. We require details of your billing address and means of payment so that we can invoice you for usage fees and any additional charges.
l. After we have checked your driving license and billing address, you will receive confirmation of your membership.
Methods of payment
We currently offer the following methods of payment:
- Credit card
- PayPal
- SEPA (currently not for LH Carpool)
Payments will be made according to the payment method selected by you. We reserve the right to refuse selected payment methods.
You are obliged to ensure that your (bank) account, which is used for the direct debit or (SEPA) direct debit procedure, or any other chosen means of payment has sufficient funds. If the amount collected is debited back by the bank and you are responsible for this circumstance, the fees arising from the chargeback shall be borne by you. We reserve the right to make further claims.
When paying by credit card and PayPal, the time of payment corresponds to the time of the order. If the payment service provider "PayPal" is used, payment is processed via PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg, subject to the PayPal terms of use, which can be viewed at www.paypal.com. The prerequisite for this payment method is that the customer opens a PayPal account or already has such an account.
If the SEPA direct debit payment method is selected, the invoice amount is due for payment after a SEPA direct debit mandate has been issued.
Credit card and SEPA direct debit payments are processed by our external partner CyberSource Ltd, Kennet Wharf, 41-45 Queens Road, Reading RG1 4BQ, United Kingdom.
By providing the required data for a direct debit authorisation, you grant us a SEPA direct debit mandate to collect payments due and instruct your financial institution to honour the direct debits. In the case of authorised payments, you can request reimbursement of the debited amount within eight weeks, beginning with the debit date. The conditions agreed with your financial institution apply. The claim due remains valid even in the event of a return debit note. Payment by direct debit requires, among other things, a successful identity check and an IBAN and BIC-capable private current account.

2. Hertz 24/7 Token / Hertz24/7 PinCode / Hertz 24/7 App
a. Upon confirmation of your membership, we will issue your "Hertz 24/7 Token" at the same time, if required to rent a vehicle.
b. With the "Hertz 24/7 Token", the Hertz 24/7 PinCode and the Hertz 24/7 App you can lock and unlock the vehicle every time you use it. When using the PinCode, you will receive a 6-digit PinCode by email and/or SMS before the start of the rental. This PinCode is used to lock and unlock the vehicle during your rental.
c. It is prohibited to pass on, lend or sell the "Hertz 24/7 Token", the PinCode or the access data of the Hertz 24/7 App to third parties. Failure to comply with this condition will result in forfeiture of your insurance cover. As a consequence of the breach of contract, you will be personally liable for the total cost of the damage or loss incurred.
d. If you ever lose your Hertz 24/7 Token, just let us know as soon as possible and we will issue a new token on request. However, we will have to charge you for the new token. Please refer to the fees in Appendix 1.
3. make bookings
a. Before you can use the vehicle, you must reserve it and receive a reservation confirmation from us.
b. In order to make a binding reservation for a vehicle, you must first complete the registration form in full and send us a copy of all the required documents (ID card, driving license) before the start of the rental. You can send us your documents by post or email or upload them in the Hertz 24/7 app or via a Hertz 24/7 terminal. If your application is not complete and confirmed by Hertz 24/7 at least 15 minutes before the start of the rental, your booking will be automatically cancelled.
c. You can make a reservation online on our website Hertz247.co.uk or via our smartphone app. You can also make a reservation via the website of the foreign Hertz 24/7 service or the Hertz 24/7 booking page of the partner with whom you wish to make a reservation.
d. If the maximum advance booking period and the maximum rental period are exceeded, this will be indicated to you during the reservation process.
e. The minimum rental time will be shown to you when you make your reservation, but will be at least 60 minutes.
f. You will receive a confirmation of your booking by SMS on your mobile phone and/or by e-mail, depending on which options you have selected in the contact details.
4. fees for the use of the vehicle
a. If you use the vehicle, we charge by the hour.
b. The total estimated cost for each use will be calculated at the time of booking. You will be shown these costs before confirming the booking.
c. An amount of up to 150% of the usage fee will be blocked on your means of payment in advance (48) hours before the start of the agreed usage or immediately if the agreed usage starts within 24 hours. After return, the usage fee and any additional costs incurred will be charged. A prerequisite for confirmation of your booking is the successful authorisation of your means of payment. You will be notified by us if your means of payment has been declined.
d. Your means of payment will be debited at the end of use with the total usage fee as well as any additional fees that may apply. Please refer to the fees in Appendix 1.
e. If you have arranged the booking via the Customer Service Centre, we will charge you additional booking fees. Please refer to the fees in Appendix 1.
f. By agreeing to these terms and conditions, you automatically allow us to deduct any applicable fees from your payment method.
5. additional costs incurred
You will find a detailed list of costs in Appendix 1 at the bottom of the page. Appendix 1 is an integral part of these General Terms and Conditions.
a. Remember that you are a member of a car sharing network. If you do not comply with the terms and conditions of the network, this will affect both "Hertz 24/7" and the other users of the network.
b. If you return the vehicle late, we will charge you for the late return in addition to the usage costs. The amount of the costs depends on whether you have informed us or not.
c. If you do not inform us of the late return, we will have to charge you for the delay, even if there is no other customer waiting for the vehicle.
d. We will charge you additional fees in accordance with the detailed list in Appendix 1, but in particular in the following cases:
i. If you return the vehicle with a fuel tank that is not full.
ii. If you return the vehicle in very poor condition (e.g. dirty), if you have smoked in the vehicle or if you have carried pets in the vehicle.
iii. If you have lost the keys, the vehicle documents or the parking card.
iv. If you have not switched off the headlights or other active consumers or if you have forgotten to remove the ignition keys from the ignition switch or to lock the vehicle.
e. If you have not parked the vehicle at the designated parking place but at any other place without informing us, we will charge you additional fees, parking costs and other costs if the vehicle has to be towed away. The same applies if you do not return the vehicle to the booked return location.
f. If we are forced to pay any fines for road traffic offences, or any other offences that relate back to the period during which the vehicle was in your possession, we will charge you the relevant administration fees. In addition, you are responsible for paying the fine.
g. By agreeing to these terms and conditions, you automatically allow us to deduct any applicable fees from your payment method.
h. All fees will be waived if you can prove that you are not responsible for the damage, that no damage was caused or that the actual damage caused is significantly less than the fee.
Please also note the possible contractual penalties for breach of contract under point 20.
6. early return, cancellation
a. If you no longer need the vehicle, you can cancel the booking. To avoid being charged for the full period of use, you must cancel your booking at least two hours before the reserved period. If you do not inform us at least two hours in advance, we will charge you for either eight hours or your entire booking period, whichever is shorter.
b. Even if you return the vehicle early, we must charge you for the full booking period or a period of eight hours, whichever is shorter.
7. our services for you as a customer
a. Upon commencement of your booked period, we will provide you with a vehicle at a designated parking space. However, as the car sharing service relies on other customers returning the vehicle to this parking space in good time at the end of their booking period, we cannot always guarantee the availability of the vehicle you have reserved.
b. If the vehicle has not been properly returned to the site by another customer, we will make every effort to find an alternative solution for you. However, it is possible that not all your wishes can be fulfilled.
c. We ensure that the vehicle is in good and safe general condition.
d. If you have a breakdown with the vehicle, please call the Customer Service Centre immediately. We will then notify a breakdown service or provide you with alternative arrangements.
8. calculation
a. You, the customer, are responsible for paying all costs associated with the booking and use of the vehicle, whether you are using the vehicle in the country of your Hertz 24/7 registration or in any other "Hertz 24/7" country.
b. When you registered, you gave us the details of your means of payment. Please inform us immediately if these details change. If we are unable to have your payment approved by your card or payment provider prior to each use, you will not be able to use the vehicle.
c. At the end of each use, we will debit your payment method with the usage fee, as well as any additional fees and compensation for any damages.
d. We are not liable for any overdraft fees or any other losses or liabilities incurred by you to your bank or credit card provider.
e. If we experience repeated problems with your means of payment or bill payment, or if your bank or payment provider rejects our direct debit, we reserve the right to temporarily suspend or permanently terminate your registration with Hertz 24/7.
f. By providing your account/credit card details, you automatically authorise us to charge your payment method for any applicable fees.
9. insurances and additional limitations of liability
a. Every time you use the vehicle, you are automatically covered by the legally required motor vehicle liability insurance. In addition, you are covered by a limitation of liability.
b. By registering, you automatically agree to the Hertz 24/7 Protection Plan that we offer you when you use the Vehicle and which forms part of your registration. Appendix 2 sets out the details and terms of the Protection Plan.
c. Provided you have complied with the Hertz 24/7 policy, in the event of damage, loss or theft of the vehicle and its parts and accessories, you will only be liable up to the amount of your excess. If the cost is less than the excess, you will be required to pay the cost of repairs and an administration fee.
d. If you have breached the terms and conditions of Hertz 24/7 or if the loss, damage or theft has been caused intentionally or by gross negligence, we may have recourse against you for third party damage and your limitation of liability under the Protection Plan will cease.
e. If your driving license is revoked, any kind of insurance cover and limitation of liability will cease to apply. In this case, you must inform the Customer Service Centre immediately.
f. If additional insurance is required for use outside the country of your registration, we will inform you of the type of insurance and debit your account accordingly.
g. If you use Hertz 24/7 outside Germany and rent vehicles there, the terms of use and rental conditions of the respective country of rental apply.
h. In the event of damage, you are obliged to inform the Customer Service Centre immediately about the damage and to fill out an accident report. In addition, in the event of an accident, the police must always be called in immediately. If these notifications are intentionally omitted, the limitations of liability shall not apply in full. In the event of a grossly negligent breach of this duty of disclosure, the limitations of liability shall lapse in a proportion corresponding to the severity of the fault of the hirer or authorised driver.
10. termination and suspension of your membership
a. The duration of your membership is unlimited.
b. If you wish to terminate your membership, please send us a notice of termination in text form by email or post and, if applicable, return your Hertz 24/7 Token.
c. In the event that you have not settled our claims or the debit of your means of payment has been unsuccessful, we reserve the right to suspend or terminate your membership with immediate effect.
d. Furthermore, we are entitled to suspend or terminate your membership with immediate effect if your driving license no longer meets our conditions for the use of our vehicles.
e. We may also suspend or terminate your membership for other reasons, such as if we believe that you are abusing our services or not complying with all applicable terms of Hertz 24/7.
11. your personal data - data protection
a. By providing us with your personal data, you authorise us to verify your data or to grant our contractual partner access to your data for the purpose of verifying that you are eligible to become a member of "Hertz 24/7" in order to fulfil the contractual purposes described herein.
b. Where appropriate, we will carry out spot checks from time to time to ensure that your license is still valid and meets our Hertz 24/7 conditions.
c. To ensure that you are always informed in good time about the latest offers from "Hertz 24/7" and can also make use of them, we will send you updates and new offers by e-mail, SMS or post. To do this, we use the data that you provided when you registered and that you have authorised us to use for advertising purposes. You can revoke your consent at any time online in your customer account or by e-mail.
d. If you accept our terms and conditions, you automatically grant us the right to debit you for all usage fees and other charges. For this purpose, you will always receive a corresponding notification of the debiting of your means of payment.
e. We forward your payment information exclusively for contractual purposes to our contractual partners, who take care of the cost processing.
f. Our privacy policy explains the measures we take to protect your data.
g. Our data protection officer for all data you entrust to us can be reached at Datenschutz@hertz.com.
h. You transfer to us the right to further process all your data in accordance with the Data Protection Act and to forward it to our contractual partners exclusively for the fulfilment of the contractual purposes described here or to grant them access to your data for this purpose.
i. Furthermore, you agree that we may store your data for contractual purposes.
j. You have the right to access, correct, delete or object to the further processing of the data. In this regard, please contact us by e-mail at Datenschutz@hertz.com.
12. changes
a. You will be notified by us if there is any change to the terms of this contract or the amount of the charges.
b. All changes, as well as changes to rates and charges, will be posted on our website at the time of your next booking. With your booking you agree to the changes.
13 Applicable law, place of jurisdiction
a. We will always endeavour to resolve disagreements amicably,
b. Should this not be possible, German law shall apply to all disputes arising from the business relationship. If our customer is a registered trader or a legal entity under public law, does not have a general place of jurisdiction in Germany or moves his place of residence or habitual abode abroad after conclusion of the contract or his habitual abode is unknown at the time the action is brought, Frankfurt am Main shall be agreed as the place of jurisdiction.
You must pay attention to this when using our vehicle:
14. before departure
a. Please inspect the vehicle and its parts and accessories for damage and be sure to notify the Customer Service Centre of any damage before you begin your journey.
b. If you fail to inform us, you will be liable for all damages. All costs and expenses will be charged to your means of payment.
c. Before driving off, make sure that all vehicle documents and other paraphernalia (vehicle documents, parking card if applicable, damage documentation) are in the vehicle.
15. regulations for the use of the vehicle
a. Vehicles must only be unlocked and locked using the PinCode, the Hertz 24/7 App or the "Hertz 24/7 Token".
b. Please remove the key from the ignition and leave it in the vehicle when you leave.
c. You have a special responsibility with regard to the vehicle and its parts and accessories for all incidents that occur during your use of the vehicle, which is why you should act with the greatest care - similar to an owner. This applies from the moment you unlock the vehicle until the end of its use when you lock it again. This also applies if another customer drives the vehicle during your reservation period or if your PinCode or "Hertz 24/7 Token" was used to open the vehicle or the reservation was booked through your user account.
d. You are liable for all fines due to traffic or parking violations and for all other costs and charges incurred during your use of the vehicle.
e. Smoking is not permitted in the vehicle.
f. It is prohibited to carry animals in the vehicle, unless they are companion animals for visually impaired people.
g. The rental price includes the free kilometers shown at the time of reservation. Any additional kilometers will be charged at the kilometer rate stated at the time of reservation. The number of kilometers driven is recorded by the onboard tracking system in the vehicle.
h. Remember that the vehicle will be used by the next Hertz 24/7 customer after you. Therefore, keep the vehicle clean and tidy.
i. Please refer to the FAQ for all the regulations that apply to the use of our vehicles.
j. If the vehicle, its parts or accessories suffer damage, you have a special responsibility. Inform us immediately if something has happened and involve the police in the event of an accident. Any liability is governed by the statutory regulations, in particular § 280 BGB.
k. If you have a breakdown or if the vehicle is defective, you must inform us immediately. You are not permitted to engage your own repairer or to engage any other person to repair or tow the vehicle without permission from the Customer Service Centre.
l. If you are involved in an accident or have damaged another person's legal property, please fill in the accident report, which can be found in the glove compartment. Inform the police of any accident as per the previous sentence. If the vehicle is stolen, the police must also be called. You are also obliged to inform the Customer Service Centre immediately. We will then give you instructions on how to proceed.
m. Please do not attach any additional equipment or devices in and on the trolley.
n. Please note that the limitations of liability also do not apply if the loss or damage was caused intentionally by you or another authorised driver. In the event of gross negligence, the limitations of liability do not apply in proportion to the severity of the fault of the hirer or authorised driver.
o. In the case of damage caused by collision with objects due to disregard of clearance heights, there is usually at least gross negligence, so that the limitation of liability does not apply in whole or in part.
16. return of the vehicle
a. The vehicle must be returned to the site at the end of the period of use. Otherwise, a late return fee will be charged.
b. The usage fee shall accrue until the vehicle is parked at the booked return location and the usage contract is terminated. Billing is by the hour. Every hour that has elapsed will be charged in full. In the event of early return, the provisions under {6b} shall apply.
c. Please return the vehicle in the same condition in which you found it. Normal wear and tear due to normal use will be taken into account.
d. Inspect the vehicle and its parts and accessories at the end of use for new damage and report it immediately to the Customer Service Centre if necessary. In the event of new damage, an accident report must be completed and submitted to the Customer Service Centre.
e. The vehicle must be parked at the Hertz 24/7 return location specified at the time of reservation.
f. If it is not possible to park the vehicle in the designated parking space, please contact the Customer Service Centre immediately by telephone and provide information about the current parking space.
g. Fuel costs are not included in the usage fee. Therefore, make sure that the tank is full when you return the vehicle. Please use the correct fuel.
h. Switch off the headlights and all other active consumers when returning the vehicle.
i. Remember to remove the ignition keys and store them in the glove box, along with the vehicle documents, manual and damage documentation booklet, and parking card if applicable. Lock the vehicle with your PinCode, Hertz 24/7 App or Hertz 24/7 Token.
j. At the end of use, terminate the rental via the on-board computer in the vehicle.
17. your obligations as a customer of Hertz 24/7
a. You are responsible for the vehicle, its parts and accessories and for all incidents that occur during your use of the vehicle. This applies from the moment you unlock the vehicle.
b. The travel restrictions of Hertz Autovermietung GmbH apply to the use of the vehicle abroad. For information on this, please contact the Customer Service Centre.
c. Only carry as many passengers in our vehicles as are permitted for the respective vehicle. Only load the vehicle up to the permissible total weight.
d. Observe all applicable laws and regulations when driving the vehicle.
e. The use of the vehicle is prohibited in the following cases:
i. For commercial road haulage.
ii. For the transport of passengers against payment.
iii. When driving off-road or on rough roads.
iv. To participate in races or competitions. To participate in races or competitions.
v. For subletting or for driver training.
vi. If the vehicle is used by persons who are under the illegal influence of alcohol, drugs or medication.
vii. In the commission of a crime or other illegal activity.
viii. For attaching a trailer or towing another car.
ix. For the transport of toxic, flammable or other substances that could damage the vehicle.
f. If you do not comply with the terms of use, the insurance benefits and limitations of liability as well as any additional insurance cover will lapse.
g. During your membership and use of our vehicles, you are required to comply with our driving license conditions and hold a valid driving license when you start driving. If there are any changes to your driving license, these changes must be notified to us immediately.
18. applicable law
If we extend our services to countries outside of Germany, or if you wish to use a vehicle outside of Germany, the terms and conditions of membership and use will be subject to these Terms and Conditions, the Hertz Rental Terms and Conditions and any additional terms and conditions to which you must agree when you make your first booking in that country. The booking and payments for the car will then be made through the Hertz office in the country where you pick up the car. However, your obligations as a Member continue to be owed to Hertz Autovermietung GmbH
19. data protection provisions
For safety reasons, all Hertz 24/7 vehicles are equipped with a GPS tracking device. The GPS tracking device enables us to determine the whereabouts of our vehicles using geodata. As standard, rented vehicles are located every 10 minutes, whereby a personal evaluation of this data does not take place as a matter of principle. The data is stored pseudonymously for a period of up to 12 months; no personal analysis is carried out during the storage period. Only in exceptional cases do we make use of the possibility to analyse the data and to establish a personal reference. Such an exceptional case exists in particular if the location is necessary
to implement the contractual relationship, in particular if there are indications that a customer is behaving in breach of the contract (e.g. leaving the contractually agreed area of use);
to prevent theft if there are reasonable indications that the vehicle has been stolen (e.g. the vehicle is not returned to the agreed return location or within the agreed return time);
to identify missing persons;
to comply with official and/or legal requirements or obligations (e.g. official, prosecutorial or judicial (investigation) requests).
The collection, processing or use of personal or personal-related (geo) data is carried out in accordance with the provisions of the Federal Data Protection Act and the European Data Protection Directive (Directive 95/46/EC). If geo data is collected, it is used exclusively for the aforementioned purposes.

20. contractual penalties
a. Driving on race tracks: Driving the vehicle on race tracks, even if these are open to general traffic, e.g. tourist drives on the Nürburgring, as well as driving for motor sport purposes, in particular at events where the aim is to achieve top speeds, or associated practice drives are prohibited. In the event of violations of this provision, Hertz may demand a contractual penalty in the amount of €2,500.*
b. Accident report: If you culpably fail to comply with your obligation to report an accident to the police and/or Hertz, or if you culpably fail to report the accident as soon as possible, i.e. late, you will be liable to pay a contractual penalty of €500 to Hertz.
c. Instruction: In the case of trucks and vans, due to the increased risk of accidents, the vehicle may only be reversed with the instruction of another person. If you reverse the vehicle yourself without instruction or allow someone else to reverse the vehicle without instruction, you will be liable to pay a contractual penalty of €900 to Hertz in the event of an accident being caused by a culpable breach of this obligation.
d. Unauthorised driver: The vehicle may only be driven by the renter or a driver authorised by us to do so. In the event of any breach of this requirement and transfer of the vehicle to a third party, you will be liable to pay a contractual penalty of €500.*
e. Entry ban: If you drive the vehicle into a country for which entry is prohibited according to the rental conditions due to the vehicle category, you are obliged to pay a contractual penalty of € 500 for the breach of the entry regulation.
*Insofar as the payment of a contractual penalty was agreed in advance, you are free to prove that Hertz has incurred no or less damage. In addition, Hertz reserves the right to assert a higher claim for damages in excess of the contractual penalty in such cases.

All fees will be waived if you can prove that you are not responsible for the damage, that no damage was caused or that the actual damage caused is significantly less than the fee.
ANNEX 2 - PROTECTION PLAN
Why does this make sense?
If you drive a vehicle, your insurance cover only includes third-party claims for death, personal injury or property damage that you cause with the vehicle during use.
However, damage to the car itself, vandalism and theft are not insured. In these situations, the additional protection plan takes effect.
What protection do I get?
Per rental contract, you are only liable for damage or vandalism to the vehicle, its parts or accessories up to the amount of the excess. If the cost of the damage is less than the excess, you will pay the lower amount, any administration costs and towing costs. All damage above the excess is covered by Hertz 24/7.
If you fill up the vehicle with the wrong fuel, we will charge the total amount of the excess.
If the vehicle is stolen, you also only pay the excess.
Please remember that the additional protection plan only applies if you follow the membership terms and conditions, use the vehicle in accordance with the terms and conditions AND the damage was not caused intentionally or by gross negligence on your part or by another authorised driver.
Please also note that in the event of damage to the vehicle, you are obliged to inform the police and Hertz immediately and to fill in an accident report. If these notifications are intentionally omitted, the limitations of liability will lapse in full. In the event of a grossly negligent breach of this duty of disclosure, the limitations of liability shall lapse in proportion to the severity of the fault of the hirer or authorised driver.
What will it cost me?
The protection plan is included in the rental price.
ANNEX 3 - ADDITIONAL PROTECTION
SuperCover
With the Hertz 24/7 Protection Plan, Collision Damage Waiver (CDW) and Theft Protection (TP) are already included in your rate. You can further reduce* or eliminate your already reduced excess in the event of damage to or loss of the Hertz vehicle, its parts and accessories, including in the event of theft, collision, attempted theft and vandalism, by purchasing an additional option, "Super Cover", provided the vehicle is used in accordance with the Hertz 24/7 Rental Terms and Conditions.
Please note the following conditions and limitations apply to SuperCover.
SuperCover does not cover:
Accessories that you rent in addition to the vehicle (e.g. Hertz NeverLost and other portable navigation devices, portable WiFi devices, child seats, etc.). You will be charged for the replacement of these items if they are lost or damaged for any reason.
Removable parts of the vehicle if they are missing at the time of return, such as keys and key fobs, luggage covers and nets, charging cables for hybrid or electric vehicles, high visibility waistcoats and warning triangles, SD navigation maps, spare wheels, tools and tyre inflators, first aid kits, fire extinguishers, etc. You will be charged for the cost of replacing these items unless the vehicle was involved in an accident or theft by a third party.
Please note that your liability for damage to or loss of the vehicle will not be waived or reduced in the following circumstances and you will be liable for the entire loss and/or damage:
- if you or the authorised driver are in breach of your obligations under the Hertz 24/7 Rental Terms and Conditions.
- if the loss or damage was caused intentionally
- if the driver is not authorised by Hertz 24/7 as a primary or additional driver or
- if the primary or additional driver is negligent (e.g. misjudging the vehicle's height, driving on unsuitable road conditions, improper use of the vehicle, contributing to the damage/theft of the vehicle) and in particular, but not exclusively, in the following cases:
- Collision with overhanging or over-swinging objects
- Hitting an obstacle that is too low to drive under
- Hitting a barrier in a multi-storey car park before it is fully open
- Careless driving on a road in poor condition causing damage to the undercarriage
- Driving on a beach and causing damage due to salt water and/or sand
- Driving through flooded roads causing damage to the engine
- Filling the vehicle with the wrong fuel or otherwise contaminating the fuel
- Damage caused by ignoring a warning light
- Burning out a clutch (which requires continuous incorrect operation) or incorrect use of the handbrake
- Damage to the rim caused by driving with a flat tyre
- Attaching unauthorised objects to the interior or exterior of the vehicle
- Carrying particularly dirty or foul-smelling materials that require additional cleaning costs or damage or burn the interior
- Damage caused by locking the keys in the vehicle or losing the keys
- Damage caused by leaving windows open
- Loss of the vehicle due to non-use of the anti-theft system (if fitted)
- Loss of the vehicle if you are unable to return the key
- Loss, damage or costs incurred if an electric vehicle cannot be unlocked due to a critically low battery level
*IMPORTANT: For vans, SuperCover reduces your liability, leaving an excess of €150.00 which will be charged to you in the event of a claim.
SuperCover is offered at most locations and can be purchased for an amount specified at the time of reservation and booking.
