Terms and Conditions of membership and rental
Differing from the below General Terms and Conditions Special Conditions shall apply and prevail to customers of Lufthansa CarPool powered by Hertz 24/7. These are listed on the Lufthansa CarPool website after logging in.
Hertz is offering you the opportunity to join a membership for short term car rental operated by Hertz 24/7. Your Hertz 24/7 membership is a unique membership that allows you to access a car on an hourly basis and at a convenient location. Renting a car has just became easier. Your membership will allow you to book and use the vehicle for short periods – sometimes even right after another person has just used the car. You will no longer waste your time searching for a Hertz Rent-a-Car, waiting in line or signing forms. All that needs to be done is a reservation and you are set to go and pick up your car.
As a member, we will ask each of you to respect not only the vehicle, but also these terms and your fellow members. You are all a part of the same Car Club. This agreement and the terms and conditions below governs both other members and your membership and usage of the vehicles. These terms and conditions regulate the business relations between you and us in regard to each reservation and usage of a vehicle.
By agreeing to these terms and conditions, you agree to be bound by them and to receive notice of any changes to the terms and conditions through the posting of notice of such changes on the Hertz 24/7 website.

Your membership:
1. Becoming a member & Using the Services
Application Form
a. You must complete the application form on our website, smartphone application or at the Hertz 24/7 terminal. Fill out all your details correctly (including billing information).
b. In order to receive confirmation and reminders on your bookings, you will need to provide a valid email address and your mobile phone number. Please inform us if these change during the course of your membership so that we can continue to keep you updated.
c. You need to ensure that at all times you fulfil our minimum rental qualifications. You must keep us up to date as to any change in billing details or contact information (Address & Phone Number). You are also required to notifity Hertz of any driving infringements prior to using the services.
d. To bindingly book a vehicle, you must complete the full application form and send a copy of all required documents (ID card/ passport, driver's license) prior to the planned start of your rental. If you want to benefit from special conditions or rates that may apply to specific customer groups, you must send a copy of the required documents for that as well. You may submit your documents by email or postal mail or upload them at the Hertz 24/7 terminal. If your registration is not fully completed and confirmed by Hertz 24/7 until 30 minutes prior to the booked start of your rental, your reservation will be cancelled automatically.
e. New Registration: If you want to use a promotion code, please note that only one code may be used per registration. You may cancel your membership anytime. After your membership has been ended, you may register again. However, this is only permitted if no misuse of benefit programmes is assumed. Only a person who has not been a member of Hertz 24/7 for at least 6 months is considered a new member.
f. Multiple Registrations: If a multiple registration (= repeated registrations using the same, similiar or different names) is detected by Hertz 24/7, all member accounts will be combined into one collective account and you will be informed. Multiple registrations are permitted, if you want to use several separate Hertz 24/7 services and this is allowed by us. Benefits can only be granted once in case of a new registration.
Driving Licence
g. You must be 19 years of age with a valid driving licence for at least one year and continue to maintain a valid driving licence for the duration of your membership. You guarantee that you hold a valid driver licence at time of registration.
h. You must not have any serious endorsements including driving under the influence of alcohol or drugs on your licence.
i. For processing your membership application you need to send us a copy of your driving licence as well as a copy of your identity card as verification of your address.
j. If you are holding a foreign driving licence you can still become a member. Please contact our Member Care Centre for details.
Billing Details
k. You will need to provide us with your details of your payment method so that we can verify their validity and then invoice you for rental and additional charges.
l. Once we have approved and authenticated your details, we will contact you to confirm the approval of your membership - welcome to Hertz 24/7.
2. The Hertz 24/7 Token / The Hertz 24/7 PIN Code
a. When we confirm your membership, we will issue you with your own Hertz 24/7 Token, if it is required for renting a vehicle. It will be mailed to the address which you provided in your application.
b. The Hertz 24/7 Token will be used to both lock and unlock the vehicle each time you use it. If no Hertz 24/7 Token is required for the rental, you will receive a personal 6-digit entry code ("Hertz 24/7 PIN Code") prior to your rental. The entry code is needed to lock or unlock the car during the rental.
c. You must not give, lend or sell the Hertz 24/7 Token or Hertz 24/7 PIN Code to anyone else nor let anyone else use it to drive a Hertz 24/7 vehicle. If you do not comply with this condition any insurance/coverage will be void and you will be liable for the full amount of any damage or loss incurred as a result of your breach.
d. If you require a replacement of your Hertz 24/7 Token, let us know as soon as possible and we can send a replacement. Please see the schedule of charges at the end of this agreement to confirm the associated charges for replacement access devices.
3. Making a Booking
a. You will need to reserve the vehicle before you use it
b. You must have completed the application form and submitted all required documents before you can rent a vehicle with Hertz 24/7. You can send your documents by email, postal mail or using the Hertz 24/7 terminal or smartphone application. If your registration has not been confirmed at least 30 minutes prior to the start of your rental, your booking will be cancelled automatically.
c. You can reserve the vehicle online at our website Hertz247.de, make a reservation through the smartphone application, the Hertz 24/7 terminal, or by phoning us at the Member Care Centre.
d. You can reserve the vehicle up to 6 months in advance.
e. You must book the vehicle for at least two hours on each occasion and thereafter in 1 hour intervals.
f. You will receive a confirmation of your booking by text message on your mobile and/or an email, depending on your contact information options.
4. Charges for using the vehicle
a. When you use the vehicle, you will be charged on an hourly rate or part thereof with a minimum charge of two hours.
b. The hourly rental rate for each rental will be determined when you make a booking and you will be able to view these charges before you confirm each booking.
c. We will preauthorise up to 150% of the charges (48) hours before you start your rental or immediately if your rental commences within 24 hours as a deposit on your payment method. After return of the car the charge including the additional charges will be charged. The booking will only be confirmed once authorisation has been successfully obtained. We will notify you if your payment card is declined.
d. Your account will be debited at the end of the rental for the rental charges and any additional charges which may be applicable. Please refer to the schedule 1 at the end of this agreement.
e. If you make a booking through the Member Care Centre, you will be charged an additional booking fee. Please refer to the schedule 1 at the end of this agreement.
f. By agreeing to these terms and conditions, you authorise us to preauthorise the initial charges and deduct all charges from your payment method you provided.
5. Additional charges that you will be responsible for
Please see Schedule 1 below for the detail of the Charges. Schedule 1 is part of these terms and conditions.
a. Remember that you are member of a club. If you violate the terms and conditions of the club, this will affect both “Hertz 24/7” and other members of the Car Club.
b. If you return the vehicle late, you will be charged a late return charge together with the normal rental charges. The amount will depend on whether you let us know or not.
c. Even if there is no other member waiting to use the vehicle and you do not let us know that you will be late, we will charge you a late return charge for being late.
d. You will also incur an additional charge in the following instances:
i. If you return the vehicle with less than a full tank,
ii. If you leave the vehicle in an unfit state (not clean), or you have smoked in the vehicle or allowed pets into the vehicle.
iii. If you lose the keys, vehicle documents or the fuel card.
iv. If you have not turned the lights off or forgot to lock the vehicle.
e. If you do not return the car to the designated parking space and park the vehicle somewhere else and don't inform us, then you will be charged an additional fee, any parking charges and any recovery charges if the vehicle is towed away.
f. If we are required to process road fines, parking fines or any other fines relating to the time the vehicle was in your possession, you will be charged an administration charge for dealing with it. You will also be responsible for paying any fines.
g. By agreeing to these terms and conditions, you authorise us to deduct all charges from your payment method.
h. These charges are not applicable, if you verify that you are not responsible for the damage, no damage has occurred or the actual damage is less than the specified charge.
6. Early return/Cancellation
a. If you no longer need the vehicle, you may cancel the booking. To avoid being charged for the full period of the booking, you must cancel at least two hours before the time of your booking. If you don't cancel before two hours, you will be charged for up to 8 hours or your full rental, whichever is less.
b. Even if you return the vehicle early, you will still be charged for the full rental or for the period up to 8 hours after the return, whichever is less.
7. Our Commitment to You as a Member
a. Vehicles will be available to you from designated parking spaces from the start of your booking. Other members may be returning the vehicle at the end of their booking, we cannot always guarantee that the vehicle which you have reserved will be available.
b. If a vehicle has not been returned on time by a previous member, we will try and find an alternative solution for you, but we may not be able to meet all your requirements.
c. We will ensure that as far as reasonably possible, the vehicle is in a good overall and operating condition.
d. If a vehicle breaks down, let us know immediately by phoning the Member Care Centre and we will arrange for a breakdown service provider to come to you or make alternative arrangements.
8. Invoicing
a. You are responsible for the payment of all charges in any way incurred in connection with the booking and use of a vehicle, whether you used the vehicle in the country of membership or in another Hertz 24/7 country.
b. When you joined, you gave us your payment method details. You must notify us immediately if these details change. If we cannot authorise your payment card before each rental, you will not be able to unlock and use the vehicle.
c. At the end of every rental, we will debit your account for the rental charges and any additional charges, and/or damage.
d. We will not be responsible for any overdraft charges or any other losses or liabilities which you may incur with your bank or card provider.
e. If we experience continued problems with your credit card or other invoice payment, or in the event of debit refusal by your bank, we reserve the right to suspend and/or terminate your membership of Hertz 24/7.
f. When you give us your payment method details you agree to allow us to deduct from your card for all charges that you may have incurred.
9. Insurances and Additional Protections Offered by Hertz 24/7
a. Provided you comply with the terms and conditions of rental, you will be covered by third party motor insurance as required by law and damage protection.
b. When you join you agreed to the additional damage protection plan that Hertz 24/7 offers you when you use the vehicle which is part of your membership. Please see below in Schedule 2 for the details and the terms and conditions of the protection plan.
c. If you have followed all the rules of membership, you will only have to pay up to the excess if there is damage, loss or theft of the vehicle. If the damage is lower than the amount of the excess, you will have to pay the amount of repair and an administration fee.
d. If you do not comply with the terms and conditions of rental, or if the loss, damage or theft is caused intentionally or by gross negligence, you will lose the benefit of any insurance/cover and the additional protection provided by Hertz 24/7.
e. IYou must notify immediatly us by email or postal mail of any change in your licence status as this may mean that you are no longer insured.
f. If additional insurances are required when you rent a car outside of your membership country, we will let you know what these will be and will charge your account accordingly.
g. If you use the Hertz 24/7 services outside Germany the local Terms and Conditions of rental within that country will apply. For the avoidance of doubt Hertz 24/7 members residing outside Germany will abide and be bound by German terms and conditions when renting in Germany.
h. You are obligated to inform the Customer Service Center about any damage immediately. Upon return of the vehicle you are obligated to fill in the Accident Report Form and submit it to the Hertz 24/7 customer service. If wilfully no notification is made, the liability limitation does not apply. Further, the liability limitation does not apply when the loss or damage was caused wilfully by you or an entitled user. In case of gross negligence, the liability limitations expire in relation to the severity of guilt caused by the renter or entitled user.
10. Termination and Suspension of your Membership
a. Your membership is for an unlimited period.
b. You may cancel your membership at any time by contacting us by email or postal mail. When you cancel, please return the Hertz 24/7 Token to us.
c. We may suspend your membership in the event that you have failed to pay your account or the direct debit payment was unsuccessful.
d. We may also suspend your account if your driving licence no longer meets our licence requirements for you to use our vehicles.
e. We may also choose to terminate or suspend your membership for any other reason including if we feel that you have been abusing the services or are not following the proper rules.
11. Your Information - Data protection
a. When you fill in the application details, you agree to us being able to use the details to verify who you are and make sure that you can become a Hertz 24/7 Member.
b. We will also use the licence details which you give us to check with the Licence Authorities that you can use our vehicles. We may continue to do periodic checks to ensure that your licence remains valid and still fits our membership requirements.
c. To make sure that you are fully up to speed with all the fantastic developments at Hertz 24/7, we will send you regular updates and new offers by email, text message or by post so that you can make use of them. By agreeing to these terms and conditions, you authorise us to send you these to the details which you provided in your enrolment. You can withdraw from agreeing at any time by sending us an email.
d. By agreeing to these conditions, you authorise us to debit your account for all membership charges, rental charges and any additional charges as per the statement which we shall provide to you before debiting your account.
e. We track the location of the car via GPRS for security purposes. Using the GPS tracking device we can determine the whereabouts of our cars based on Geodata. We do not locate our cars while they on rent and in use by our customers. We will make use of the positioning possibility only in absolutely exceptional circumstances. The following are exceptional circumstances as to when the tracking is necessary
i. to execute the contractual relationship, particularly in the event of any indications, that the customer is behaving against the terms of the contract (e.g. leaving the designated area of use);
ii. to prevent theft, where comparable justified indications of a theft of the vehicle exists (e.g. the car has not been returned at the agreed return location or within the agreed return time);
iii. to locate missing persons;
iv. to meet regulatory and/or legal requirements or obligations (e.g. administrative, prosecutorial or judicial request for inquiries).
If there is a collection of Geodata, it is used exclusively for the aforementioned purposes. Storage of Geodata does not take place. Accordingly you confirm that we can use this data for such reasons.
f. We will only show your payment method details to our third party payment partners.
g. Please read our privacy policy for the measures which we have in place to make sure that all your details are protected.
h. The data controller in relation to any information which we have been given by can be contacted at Datenschutz@hertz.com.
i. You agree that we may process your information as defined under the Data Protection Act.
j. You also agree that we can keep the information as part of our records to continue to administer and provide the services to you.
k. You are entitled to access, correct or delete your data or to object the processing of your data. To this effect please contact Datenschutz@hertz.com.
12. Changes
a. We will let you know if there are any changes to the conditions of this agreement and the charges.
b. Any changes, including changes to the rates and charges will be available on the website when you next make a booking. If you make a booking, then you agree to the changes.
13. Disputes
a. We will try and resolve any disputes, claims or queries which have been raised or which have been brought by either party.
b. If we cannot resolve the dispute directly with you, this agreement will be governed by German law. If our member is a general merchant or a body corporate organised under public law, if the member does not have a court of jurisdiction inland or moves the main residence or place of residence abroad after conclusion of the contract, or if the main residence is unknown at date of commencement of a suit, Frankfurt am Main is appointed place of jurisdiction.
Things to be aware of when using the vehicle.
14. Before using the Vehicle
a. You must check the vehicle for any damage and make sure that you report any damage to the Member Care Centre.
b. If you don't let us know, you will be responsible for any damage and we will deduct any costs and expenses from your charge card.
c. You must also check that the documents of the vehicle and other items (administrative papers, fuel card (if applicable), parking card, damage identification book) are in the vehicle.
15. Conditions when using the vehicle
a. You must use the Hertz 24/7 Token or Hertz 24/7 PIN Code to unlock and to lock the vehicle when you are not driving the vehicle.
b. The keys must not be removed from the vehicle, even when you leave the vehicle.
c. You are responsible for the vehicle and anything that happens to the vehicle from the moment that you unlock the vehicle until your rental is completed and you lock the vehicle. This also applies if the vehicle is used by another member during your booking, if your Hertz 24/7 Token or Hertz 24/7 PIN Code was used to unlock the vehicle, or if the reservation was made through your membership account.
d. You are responsible for any parking fines, bus lane fines, speeding fines, clamping fees, and any other charges or fees which are incurred while using the vehicle.
e. You must not smoke or allow anyone else to smoke in the vehicle.
f. No pets are allowed in the vehicle at any time, except if required as a service animal for the visually impaired.
g. A free mileage of 100km is included in the rental charges. You will need to pay an additional charge of 0,19€ per kilometre. The number of kilometres driven is determined by the onboard tracking system.
h. Remember that another member of Hertz 24/7 will use the vehicle after you, so keep it clean and tidy.
i. Please look at the online FAQs for any additional information on using the vehicle.
j. If damage is done to the vehicle, you are responsible, and you must let us know immediately if anything happens.
k. If the vehicle breaks down, or there is a fault with the vehicle, you must let us know immediately. Do not arrange for your own breakdown repair service or allow any other person to service or fix the vehicle without permission from the Member Care Centre.
l. If you have an accident you must fill an incident report form in the glovebox and inform the police if required. If the vehicle is stolen you must inform the police. Let us know straight away and we will tell you what to do.
m. You should not add or attach any equipment or device to the vehicle.
n. You are fully responsible for damage caused by failure to assess the height of the vehicle and striking overhead or overhanging objects. This responsibility is not excluded by any waiver.
16. Returning the Vehicle
a. You must return the vehicle before the end of your rental period; otherwise, a late return fee will be applied.
b. Rental charges will continue to accrue until the car is returned to its parking space and the rental is closed. For early return, see clause {6b}
c. Ordinary wear and tear due to reasonable use expected, you must return the vehicle in the same condition in which you received it.
d. At the end of the rental, inspect the vehicle for any damage, and report it to the Member Care Centre.
e. The vehicle must be parked in one of the Hertz 24/7 parking bays at the same location where you picked up the vehicle.
f. If you cannot park in the designated parking space, phone the Member Care Centre immediately to notify them where you are parking the vehicle.
g. Fuel is not included in the rental price. You must make sure to return the vehicle with a full tank fo fuel.
h. Turn off the lights of the vehicle.
i. Remember to leave the keys, the documents of the vehicle, the fuel card, the parking card, and the damage identification book in the glovebox and lock the vehicle using the Hertz 24/7 Token.
j. At the end of the rental, on each occasion, you must ensure that you close off the rental using the 'end rental' button in the vehicle.
17. Your responsibilities as a member
a. You are responsible for the vehicle and anything which happens to the vehicle from the moment that you unlock the vehicle with the Hertz 24/7 Token.
b. The vehicle may be driven outside of Germany. The travel restrictions of Hertz Rent-A-Car shall apply. Contact the Member Care Centre for more information.
c. You must only use the vehicle to carry passengers which do not exceed the designed seating capacity.
d. You must only use the vehicle in accordance with all highway and other applicable laws and regulations.
e. The use of the vehicle in the following conditions is not allowed:
i. for any hire or reward,
ii. to carry passengers for remuneration,
iii. for off road or on roads which are unsuitable,
iv. to take part in any race or contest,
v. to sub-rent or for driver training
vi. by any person who is under the influence of alcohol or any drug or medication which is prohibited,
vii. in the carrying out of any crime or any other illegal activity,
viii. for the towing of a trailer or vehicle,
ix. To carry any substance which is toxic, flammable, or which may damage the vehicle.
f. If you don't comply with the terms and conditions of use of the car, you will lose the benefit of any insurance cover and additional protection which you may have.
g. You must continue to meet all our licence requirements and have a valid driver licence while you are a member and whenever you use the vehicle and to let us know immediately if there are any changes to your licence status.
18. Applicable Law
If and when you make a reservation for a vehicle outside of Germany, then the conditions of membership and use shall be governed by these terms and conditions, subject to any additional terms and conditions which you will be asked to agree to when you first make a booking in that territory. The booking and rental of the vehicle will then be with the Hertz 24/7 company in the territory where you pick up the vehicle, but your membership obligations shall remain with Hertz Autovermietung GmbH.

SCHEDULE 2 – ADDITIONAL PROTECTION PLAN
Why do I need to take this out?
When you drive the vehicle, you are only insured and protected against any claims from any third person for death, personal injury or damage to property caused by the vehicle during your rental.
You are not protected against any damage done to the vehicle itself, vandalism or theft of the vehicle. The Additional Protection Plan covers you for these situations.
What protection will I get?
You will only be responsible for damage or vandalism to the vehicle for up to the amount of the excess for each time that you rent the vehicle. If the damage to the vehicle is less than the amount of the excess, you will only be responsible for the lesser amount, any administration fee and any towage costs. Any damage more than the amount of the excess will be covered by Hertz 24/7.
If you put the wrong fuel into the vehicle, you will be charged the full amount of the excess.
If the vehicle is stolen, you will only be charged the amount of the excess.
Please remember that the additional protection plan only covers you as long as you have followed the rules of the membership and have used the vehicle in accordance with the terms and conditions AND the damage was not caused intentionally, by gross negligence of you or an authorised driver.
